Webmaster and SEOMS Challenged 'App Store' Trademarking, Apple Fighting Back
Apple's effort to trademark 'App Store' has been met with lots of criticisms, specially from rival company Microsoft. The challenge was mostly based on Microsoft's claim that 'app store' is too generic to be trademarked, and that even Apple CEO Steve Jobs used the term in one occasion describing the competition's 'app stores.' But Apple is standing up to the opposition, slamming Microsoft's challenge as "missing the forest for the trees." Apple argues that if Microsoft sees 'app store' as a generic term, what do they think of the term 'Windows', which Microsoft had fought for for years, trademarking it despite opposition on its generic-ness. "Having itself faced a decades-long generics challenge to its claimed Windows mark, Microsoft should be well aware that the focus in evaluating generic-ness is on the mark as a whole and requires a fact-intensive assessment of the primary significance of the term to a substantial majority of the relevant public," says Apple. Microsoft on the other hand is not moving a hair on its stand. It still believes by its argument, and will oppose the trademarking application at all cost. "We remain confident in our case and believe that the term 'App Store' should continue to be available for use by all without fear of reprisal by Apple," Microsoft commented on the issue. Really, now that we're on the discussion of how generic a term is, I find it ironically funny that Apple does not see its name. It's even more generic than Windows, and they had it trademarked as well. You can talk about...
